As I recall, 'they' declared it was a 'fee' so that it would pass muster.
(Something about where tax laws must be begat meant it was Un-Constitutional
if it was a tax . . . then the Supreme Court crammed a camel through
a needle to find it 'Constitutional'.) (But, the responsibilities and
powers of the federal government are supposed to be limited to what
the Constitution says they can do - and health care is most assuredly
NOT among the power or responsibilities of the federal government.)

It SHOULD be very difficult to remove a Supreme Court
Justice. Just like amendments to the Constitution
should be very difficult to enact. But the primary
job for the Supreme Court should be to strike down
any and all Laws or Un-Constitutional actions taken by anyone.
The way obozo-care was passed . . . the fact that congress NEVER
debated or even studied it . . . the fact that it had thousands of
little parts never even discussed . . . AND the fact that 'health care'
is NOT listed as a power or responsibility of the federal
government in the Constitution . . . SHOULD have had the Supremes tossing it out on its azz.
