He has already pleaded guilty. Nothing prevents the judge to look into his lying further. Nothing. It is no longer a negotiation between parties. He was waiting to be SENTENCED!

A retired judge will also examine whether the former national security adviser committed perjury.

Judge Sullivan also asked Judge Gleeson to explore the possibility that by trying to withdraw his pleas, Mr. Flynn opened himself to perjury charges.
