Justice Clarence Thomas says ex-West Point cadet should be able to sue over alleged rape after Supreme Court decides not to hear the case
Justice Clarence Thomas dissented from a Supreme Court decision Monday not to hear the appeal of a former West Point cadet who alleged she was raped at the academy, saying the court should have taken the case to correct decades of injustices.
In throwing out the former cadet’s case, lower courts cited a 1950 Supreme Court decision that said military personnel cannot sue for injuries "incident to" their military service. But Thomas said the 71-year-old case, Feres v. United States, was wrongly decided.
