A U.S. appeals court ruling barred the expulsion of migrant families on public health grounds if doing so would subject them to persecution.

During the pandemic the U.S. government has used the Title 42 public health law to give border officials the authority to turn migrants away even if they were seeking asylum.

The Biden administration had allowed an exception for migrant children unaccompanied by a parent or guardian.
