Yep, you have to face the grand jury. Don't know the exact statistics, but every Good Samaritan who shoots an armed assailant in similar circumstances that I've heard of in the State of Texas is regularly no-billed. Often times, the grand jury's conclusion is "Well done, and thank you for your service to the community!" BUT, the coup de grâce at the end, in this case, could be a little more problematic.

Wouldn't be a hard decision for me. I'd pin a medal on his chest.

Armed diner who fatally shot robber in Houston restaurant heist will face grand jury

As the suspect heads for the exit with his loot, the 46-year-old diner sitting in a booth stands up, pulls out a handgun and opens fire on the robber, causing him to collapse.

Then, while standing directly over the wounded intruder, the customer shoots him again at point-blank range, as seen in the video.
