The Founders left a MASSIVE loophole, inviting abuse, when they failed to include an 11th Amendment to protect the Bill of Rights with massive, non-discretionary penalties for anyone who violated the Bill of Rights with respect to another citizen.
And, specifically, they should have stripped all license, all pension, all citizenship from anyone who worked for the Federal Govt and was found to denied Civil Rights expressly put in the Bill of Rights.
Without that, only common decency, keeps government employees as bay. There are no real penalties for endlessly gaming loopholes in order to commit crimes without any real recourse.
I give the Founders a break because they couldn't have expected the State would ever become so large and powerful. But, going forward, I hope future Republics learn from our mistakes: The government WILL be gamed and primarily it will be gamed by those who run the government.
