Actually. . . Both should be seen as 'protected speech'.

However, in the case of the potted plant, unless the perpetrator was hanging around with a fire extinguisher to see that the 'fire' did not get out of hand I'd be tempted to call it simple arson.

Lastly, what I think the perpetrator should have done was to simply steal the 'pride flag' and take it outside the school somewhere 'safer' to burn it. (Or if the whole pot was 'pride' steal the whole thing.)

'Pride' has no business being 'taught' in Elementary Schools.

A spokesperson for Los Angeles Police said Wednesday the incident is being investigated as a “vandalism hate crime.”

“There was a small potted plant that was set on fire on the campus and the plant had a small (4 x 6 inch) PRIDE flag inside the potted plant container. Both the plant and the flag were destroyed by the fire,” he said.

Burn the homo flag=hate crime.
Burn the US flag=protected speech.
