In the above case I'd blame the driver for not paying attention to where the car was going. (GPS will not tell one if there is a car stopped in the road.)

But in the case of air traffic control, the pilot is supposed to obey the air traffic controllers - because the controllers have radars and such and are supposed to ensure collisions do NOT occur.
