And the Republican warning was what; that Obama is not allowed to act in a manner as proscribed by the Constitution of the United States of America:

Article II, Section 2:

The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.

Don't you just love it when Republicans choose to defend the Constitution ONLY when it suits their agenda...

BTW, George W. Bush availed himself of HIS Constitutional right to make recess appointments at least 7 times during his term in office so it's not like Obama suddenly discovered some obscure loophole that no one had ever heard of before.
