...it isn't likely that anyone would have been carrying a gun that would penetrate that kevlar stuff. A .44 mag might not have penetrated the armor, but then a city bus wouldn't have penetrated it either, but it would still kill him.
...when the perp gets to pick the time and the place and plan for it for months, it isn't likely that anyone in the "kill zone" is gonna win the battle with his quick draw and uncanny aim.
