Not that it is Un-Constitutional. More like, so far,
the courts have declined to stick their noses into
it.

Time after time, when members of Congress have sued in the courts, because the Executive Branch did something that they believe frustrated the will of Congress, they have been met at the door of the courthouse with a polite refusal to let them in.

Not only is this a waste of tax-payer's money, the real irony is that on the face of it, it's simply UNCONSTITUTIONAL.

John Boehner does not have 'standing' with the court to bring a lawsuit against a President of the United States and nothing that Congress says can change that. The Constitution trumps Congressional resolutions.
