yep, as quoted in my previous post!

it is probably the most important expectation of the office of the ag that it should just say no to unjust and unlawful actions by the executive. such opposition is a canary in the constitutional coalmine. it tells you something important about the health of the body politic. AsG owe their deference to the constitution and the people it represents and protects.

the fact that some people suggest the primary role of the ag is that they must be loyal to the executive is prima facie evidence that the person has no clue. hello, donald. hello, newt. the ag cannot "betray" the president if they act in accordance with the law. the betrayal is by the president of an ag who is sworn to defend the constitution.

these are steps along the pathway to autocracy. if you want to avoid arbitrary power, you need to have folks step up for justice and the rule of law.

Acting Attorney General fired after saying she won't ask DOJ to defend Trump travel ban

In March 2015, Yates underwent Senate confirmation hearings to become a deputy attorney general under President Obama.

Sessions, one of the lawmakers vetting her, wanted to make sure she was willing to oppose the President if he stepped beyond the rule of law.

“Do you think the Attorney General has the responsibility to say no to the President if he asks for something that’s improper?” Sessions asked.

“If the views the president wants to execute are unlawful, should the Attorney General or the Deputy Attorney General say no?” he stressed.

Yates’ answer gives good insight into how she abruptly found herself without a job Monday after publicly contesting President Trump’s executive order.

“Senator, I believe the Attorney General or the Deputy Attorney General has an obligation to follow the law and the Constitution, and to give their independent legal advice to the president,” Yates said at the time.
